1. Presentation

Kobver is a design agency specialized in creating book covers for independent authors and publishing houses.

All services are exclusively creative work, provided remotely, and delivered in digital format.

2. 2. Scope of Application

These Terms and Conditions apply to any order placed via our website, social networks, or direct communication (email, messaging, etc.).

Placing an order implies full and unconditional acceptance of these terms.

3. Order & Payment

All orders must be paid in full in advance.

An order is considered confirmed once payment has been received and the briefing form has been duly completed.

No design work will begin without both of these elements.

Prices are fixed and announced in advance. No price adjustments will be made after confirmation.

4. Deadlines & Delivery

Delivery times are provided for reference only.

Any delay caused by a lack of response or approval from the client will automatically push back the delivery date.

Final delivery includes print-ready files (PDF, high-resolution JPEG, or any other format specified in the offer).

5. Revisions

The number of revisions included depends on the package chosen by the client (e.g., 1, 2, 4, or unlimited).

One revision corresponds to a set of modifications grouped into a single request (text, color, typography, etc.).

Any request for revisions beyond the included number will be subject to an additional quote or unit billing.

Revisions must comply with the initial brief.

A complete change of artistic direction (style, composition, or overall concept) will not be accepted once a concept has been approved.

6. Cancellation & Refunds

If the client abandons the project without response for more than 15 days, the project will be considered closed and non-refundable.

A full refund or additional free adjustments may only be offered if:

– The number of revisions included in the package has been fully used, and

– The final cover remains objectively unusable for professional publication, notably in the following cases:

• The delivered visual is clearly inconsistent with the validated brief,

• The composition or graphic elements make the cover unreadable, unprofessional, or unsuitable for the literary genre,

• The delivered file does not meet the mandatory technical requirements of publishing platforms (e.g., Amazon KDP, IngramSpark),

• The final result contains major errors (e.g., incorrect title spelling, wrong format, poor-quality image inconsistent with the validated preview).

No request will be accepted if the cover has already been approved or publicly used in any communication, publication, or preview.

7. Client Responsibilities

The client is fully responsible for the texts provided (title, blurb, author name, legal notices, etc.).

Kobver does not carry out any spelling, grammar, or legal checks on the provided content.

In case of an error on the cover caused by content supplied by the client, no free correction will be made.

8. Copyright & Intellectual Property

Once the final project has been delivered and fully paid, the client obtains full ownership and unlimited rights to use the delivered version of the cover (commercial use, reproduction, distribution, adaptation, worldwide, with no time limit).

Kobver retains the right to use drafts, mockups, rejected proposals, and finalized covers solely for promotional purposes (portfolio, website, social media), unless the client explicitly requests otherwise in writing.

9. Confidentiality

All information exchanged in the context of the service is strictly confidential and will never be disclosed to third parties.

Exploitation rights

Full exploitation rights (commercialization, printing, distribution) are transferred only once full payment has been received.

10. Disputes & Governing Law

In case of a dispute, an amicable solution will be sought as a priority.

Failing that, the dispute will be subject to French law and brought before the competent courts of Lyon, the city of the company’s registered office.

Acceptance Clause

Placing an order with Kobver implies full and unconditional acceptance of these Terms and Conditions of Sale. The client acknowledges having read, understood, and accepted them without reservation.
